Terms of Use

These Terms of Use govern your use of ImageSetta and related services provided by:

By downloading, accessing, purchasing, or using ImageSetta, you agree to these Terms to the extent permitted by applicable law.

These Terms supplement Apple's applicable App Store terms and Apple's Standard End User License Agreement.

They do not replace Apple's Standard EULA.

If mandatory law or an applicable Apple agreement gives you rights that cannot lawfully be limited by these Terms, those rights continue to apply.

1. ImageSetta

ImageSetta is an image-processing application that provides tools for working with images and related files.

Features may include functions for:

• opening images;
• editing images;
• adjusting images;
• fitting images;
• straightening images;
• converting images;
• exporting images;
• saving images;
• sharing images;
• printing images.

Available functionality may change as ImageSetta develops and is updated.

2. License to Use ImageSetta

Your license to download and use ImageSetta is subject to Apple's Standard End User License Agreement and applicable App Store terms unless a different license agreement is expressly made applicable through Apple.

These Terms contain additional conditions concerning:

• ImageSetta's functionality;
• purchases;
• Lifetime entitlements;
• user responsibilities;
• support;
• backend services;
• acceptable use;
• related services.

Nothing in these Terms transfers ownership of ImageSetta or its intellectual property to you.

3. Free Functionality

ImageSetta may make some functionality available without payment.

The features, usage limits, or other conditions applicable to free use are those shown in the app at the relevant time.

Unless mandatory law provides otherwise, free functionality may be:

• added;
• changed;
• limited;
• reorganized;
• discontinued

in future versions.

A change to free functionality does not remove a valid paid entitlement that expressly grants access to the affected paid functionality.

4. Lifetime Purchase

ImageSetta may offer a one-time In-App Purchase described as Lifetime, Lifetime Access, or similar wording.

Unless the purchase screen expressly states otherwise, a Lifetime purchase means a one-time purchase that unlocks the applicable paid ImageSetta functionality without a recurring subscription fee.

"Lifetime" does not mean the lifetime of:

• the purchaser;
• the developer;
• a particular device;
• Apple;
• any other individual;
• any company.

It means access to the purchased entitlement for the commercially supported lifetime of ImageSetta, subject to:

• continued technical ability to provide the application and relevant functionality;
• operating-system compatibility;
• hardware compatibility;
• applicable App Store requirements;
• platform requirements;
• legal or regulatory requirements;
• security requirements;
• circumstances outside the developer's reasonable control.

A valid Lifetime entitlement will not deliberately be converted into a recurring subscription merely to require the same purchaser to pay repeatedly for the same entitlement.

A valid Lifetime entitlement will not deliberately be removed solely for the purpose of forcing the purchaser to buy the same entitlement again.

This does not prevent the development or sale of:

• separate future applications;
• substantially different products;
• substantially different services;
• genuinely new functionality that was not included in the entitlement originally purchased.

Any such distinction remains subject to applicable consumer law.

Marketing statements concerning Lifetime access should be interpreted consistently with this section and with any mandatory rights provided by applicable law.

5. Purchases

Purchases made within ImageSetta through Apple's In-App Purchase system are processed by Apple.

Apple controls matters including:

• payment processing;
• billing;
• payment methods;
• App Store transaction infrastructure;
• transaction records maintained by Apple;
• refund processing through Apple's systems.

ImageSetta does not receive your complete payment-card information.

A purchase may be subject to Apple's terms in addition to these Terms.

6. Restore Purchases

Where supported by Apple's systems and the relevant product type, ImageSetta may provide a Restore Purchases function.

Restoration depends on valid Apple transaction and entitlement information.

You may need to use the Apple Account associated with the original purchase.

ImageSetta cannot create a valid Apple purchase record where Apple does not provide one.

ImageSetta also cannot legitimately treat forged, manipulated, or invalid transaction information as proof of a valid purchase.

If restoration fails because of a technical issue in ImageSetta, contact support so that ImageSetta has a reasonable opportunity to:

• investigate the problem;
• reproduce the issue;
• verify the entitlement;
• correct an ImageSetta-side technical defect where one exists.

7. Refunds and Withdrawal Rights

Purchases made through the App Store are processed by Apple.

Requests for App Store refunds should normally be submitted through Apple's official Report a Problem service or another refund method made available by Apple.

Apple determines refund requests through its own systems, applicable Apple terms, and applicable law.

ImageSetta does not promise, guarantee, or independently control whether Apple will approve a particular refund request.

Consumers in the European Union, European Economic Area, or other jurisdictions may have statutory withdrawal, cancellation, conformity, or refund rights.

Depending on the nature of the transaction, statutory withdrawal rights for digital content may also be subject to specific legal conditions and exceptions, including circumstances in which digital supply begins following the consumer's request and acknowledgment under applicable law.

Nothing in these Terms removes or restricts any mandatory right to:

• a refund;
• withdrawal;
• cancellation;
• repair;
• correction;
• replacement;
• price reduction;
• termination;
• another remedy provided by applicable consumer law.

Where Apple's systems provide the mechanism for exercising a refund or withdrawal right relating to an App Store transaction, the request should generally be made through that mechanism.

8. Opportunity to Investigate Technical Problems

If you believe that ImageSetta or a paid entitlement is not functioning correctly, please contact support and provide enough information for the issue to be investigated.

Where reasonable in the circumstances, you agree to give ImageSetta an opportunity to:

• reproduce the issue;
• diagnose the issue;
• determine whether the issue originates in ImageSetta, iOS, Apple services, the device, or another service;
• correct an ImageSetta-side defect;
• explain the functionality where no defect exists.

This provision does not require you to:

• waive a mandatory legal right;
• surrender a statutory remedy;
• delay an immediate remedy where applicable law gives you one.

9. Your Images and Content

You retain ownership of images and other content that you own.

ImageSetta does not acquire ownership of your images merely because you process them using the application.

You are responsible for ensuring that you have the rights, permissions, and lawful basis necessary to:

• use;
• edit;
• process;
• reproduce;
• export;
• distribute;
• print;
• share

the content you process through ImageSetta.

Do not use ImageSetta to infringe:

• copyright;
• privacy rights;
• publicity rights;
• confidentiality obligations;
• contractual rights;
• intellectual-property rights;
• other applicable rights.

10. Local Image Processing

ImageSetta is designed so that image processing takes place locally on your device.

The ImageSetta backend is not intended to act as storage for your image library.

When you export, save, share, print, or send content to another destination, responsibility for that copy may pass to:

• an operating-system function;
• another application;
• a cloud-storage provider;
• a printer;
• a third-party service;
• a recipient.

Their terms and privacy practices may apply separately.

11. Backups and Original Files

You are responsible for keeping appropriate backups of important original images and files.

Do not treat ImageSetta as your only backup location.

Before overwriting, deleting, converting, exporting, replacing, or otherwise modifying an important file, you should preserve the original where loss could cause material harm.

ImageSetta is designed to process files reliably, but no software environment is entirely free from failure.

Potential sources of loss or corruption may include:

• software errors;
• storage-device failures;
• operating-system failures;
• hardware failures;
• third-party service failures;
• user actions;
• insufficient storage;
• interrupted operations;
• external system problems.

12. File Formats, Metadata and Output

Image processing may change technical properties of a file.

Depending on the function used, an output file may differ in:

• dimensions;
• compression;
• file format;
• metadata;
• orientation;
• colour information;
• filename;
• encoding characteristics;
• other technical properties.

You are responsible for checking exported results where a particular technical specification is important.

ImageSetta does not guarantee that every possible file created by every:

• camera;
• editor;
• application;
• codec;
• operating system;
• third-party service

will be supported.

13. Acceptable Use

You may not use ImageSetta to:

• violate applicable law;
• deliberately infringe another person's rights;
• attack ImageSetta's systems;
• interfere with ImageSetta's systems;
• overload backend infrastructure;
• bypass security controls;
• compromise backend services;
• circumvent paid-feature or entitlement controls;
• forge purchase information;
• manipulate entitlement information;
• knowingly submit fabricated transaction information;
• distribute malicious code through any related service;
• abuse automated backend endpoints;
• intentionally impose unreasonable load.

Nothing in this section prohibits lawful:

• security research;
• interoperability;
• reverse engineering;
• other activity

where applicable law grants a right that cannot lawfully be restricted by contract.

14. Fraudulent or Knowingly False Claims

ImageSetta takes legitimate complaints, refund requests, consumer claims, technical reports, and legal rights seriously.

Nothing in these Terms is intended to discourage you from exercising a genuine right or making a genuine complaint.

However, knowingly:

• falsifying transaction information;
• manipulating entitlement evidence;
• submitting fabricated evidence;
• making deliberately false factual claims;
• presenting a forged purchase record;
• attempting to obtain paid functionality through fraudulent verification data;
• intentionally misrepresenting the status of an Apple transaction

may be investigated and contested.

Relevant records may be preserved where reasonably necessary for:

• fraud prevention;
• dispute resolution;
• security;
• legal claims;
• protection of the entitlement system.

A disagreement, unsuccessful support interaction, refund request, or legitimate consumer complaint is not by itself evidence of fraud.

15. Updates

ImageSetta may receive updates to:

• correct bugs;
• improve compatibility;
• improve accessibility;
• address security issues;
• comply with App Store requirements;
• comply with legal requirements;
• improve existing functionality;
• add functionality;
• change functionality;
• remove functionality where reasonably necessary.

Some updates may require:

• a newer version of iOS;
• compatible hardware;
• current Apple services;
• updated platform functionality.

ImageSetta does not guarantee indefinite compatibility with every historical device or operating-system version.

Mandatory consumer rights relating to digital content remain unaffected.

16. Availability

ImageSetta aims to remain functional and supported, but uninterrupted or error-free operation cannot be guaranteed.

Functionality may be affected by matters including:

• iOS changes;
• App Store changes;
• StoreKit changes;
• Apple services;
• device limitations;
• third-party services;
• security incidents;
• legal requirements;
• technical failures;
• infrastructure problems;
• events outside the developer's reasonable control.

Temporary unavailability does not by itself mean that a valid Lifetime entitlement has been cancelled.

17. Third-Party Services

ImageSetta may rely on or interact with third-party services, including Apple and infrastructure providers.

ImageSetta is not responsible for independent third-party services that it does not control.

For example, Apple's services may include:

• the App Store;
• purchase processing;
• Apple Account services;
• StoreKit;
• system permissions;
• Photos;
• Files;
• printing;
• sharing;
• other operating-system services.

Where ImageSetta itself is responsible for integrating with a third-party service, this section does not remove responsibility that applicable law places on ImageSetta for its own software or integration.

18. Intellectual Property

ImageSetta, including its:

• software;
• original interface elements;
• original graphics;
• branding;
• documentation;
• original text;
• developer-owned design elements;
• other developer-owned material

is protected by applicable intellectual-property law.

Except for the license granted under Apple's applicable EULA, App Store terms, and applicable law, no ownership rights in ImageSetta are transferred to you.

Third-party components remain subject to their respective licenses.

19. Feedback

If you voluntarily provide suggestions, ideas, feature requests, or general product feedback, you allow ImageSetta to use that feedback to improve the product without an obligation to compensate you.

This does not transfer ownership of:

• your images;
• private files;
• personal data;
• other content submitted solely for support purposes.

20. Support

Support is available through:

ImageSetta may request diagnostic information reasonably necessary to investigate a problem.

Do not send:

• passwords;
• complete payment-card information;
• unrelated sensitive personal data;
• private material that is not necessary to investigate the issue.

Support availability, response times, and available languages may vary.

Unless expressly promised otherwise, ImageSetta does not include:

• a guaranteed response time;
• a guaranteed resolution time;
• a service-level agreement;
• 24-hour support.

The support address may also be used for ordinary questions relating to ImageSetta.

Where applicable law requires a particular form or method for a formal legal notice, those requirements remain unaffected by the availability of the support email address.

21. No Professional Advice

ImageSetta is an image-processing utility.

Outputs do not constitute:

• legal advice;
• medical advice;
• financial advice;
• forensic certification;
• archival certification;
• professional photographic certification;
• identity-document certification;
• other professional advice or certification.

Where an image must satisfy a:

• legal standard;
• regulatory standard;
• evidentiary standard;
• archival standard;
• printing standard;
• identification standard;
• professional technical standard,

you are responsible for confirming that the resulting file meets that requirement.

22. Disclaimer of Warranties

To the maximum extent permitted by applicable law, ImageSetta is provided on an "as available" basis without warranties beyond those that cannot legally be excluded.

ImageSetta does not guarantee that:

• every possible file will be compatible;
• the application will always operate without interruption;
• the application will always operate without error;
• every third-party system will remain compatible;
• every future iOS version will remain compatible;
• a particular output will be suitable for a purpose that has not been communicated to ImageSetta;
• Apple or another third party will continue providing a particular service indefinitely;
• future versions of iOS or third-party services will behave exactly as current versions do.

Nothing in these Terms excludes:

• statutory warranties;
• conformity requirements;
• consumer guarantees;
• other rights

that cannot lawfully be excluded.

23. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

These Terms do not limit liability that cannot legally be limited under applicable consumer law or other mandatory law.

To the maximum extent permitted by law, ImageSetta is not liable for indirect or consequential loss that:

• was not reasonably foreseeable;
• resulted from circumstances outside the developer's reasonable control.

You remain responsible for:

• maintaining backups of important files;
• retaining originals where appropriate;
• checking important exported results.

Where applicable law permits a contractual financial limitation for a particular claim, the aggregate liability arising from your use of ImageSetta will not exceed the amount you actually paid for ImageSetta or the relevant paid entitlement giving rise to the claim.

This limitation does not apply where applicable law prohibits such a limitation.

Nothing in this section is intended to exclude liability for conduct or harm for which liability cannot legally be excluded or limited.

24. Backend Security, Abuse and Purchase Entitlements

ImageSetta may protect its backend against:

• attacks;
• automated abuse;
• forged verification requests;
• manipulated transaction information;
• invalid entitlement claims;
• malicious traffic;
• conduct that threatens the security or integrity of the service.

Where reasonably necessary, ImageSetta may:

• reject invalid verification requests;
• reject malformed verification requests;
• rate-limit abusive requests;
• temporarily restrict access to backend endpoints involved in an attack;
• block requests containing forged transaction information;
• block requests containing manipulated transaction information;
• reject transaction information that Apple cannot verify;
• investigate attempted fraud or abuse.

These technical protections do not give ImageSetta a general right to cancel a valid Lifetime entitlement merely because a user:

• makes a complaint;
• requests a refund;
• exercises a consumer right;
• raises a dispute;
• criticizes ImageSetta;
• contacts support.

For an Apple In-App Purchase, entitlement status should be determined using valid Apple-provided transaction or entitlement information.

ImageSetta will not intentionally override a valid current Apple entitlement merely to deprive a purchaser of functionality already purchased.

Where Apple reports that a transaction has been:

• refunded;
• revoked;
• otherwise made invalid as a current entitlement,

ImageSetta may reflect that status.

A valid non-consumable Lifetime entitlement will not intentionally be revoked solely as punishment for unrelated conduct.

Nothing in this section prevents proportionate action that is:

• required by law;
• necessary to stop an active attack;
• necessary to protect backend infrastructure;
• necessary to reject fraudulent or technically invalid verification requests.

25. Changes to These Terms

These Terms may be updated where reasonably necessary because of changes to:

• ImageSetta;
• applicable law;
• security requirements;
• App Store requirements;
• platform requirements;
• functionality;
• technical infrastructure;
• third-party services.

Changes do not retroactively remove mandatory rights that you already have.

Where a material change requires notice or consent under applicable law, notice or consent will be handled as required.

The date at the beginning of these Terms identifies the current version.

26. Ending Use of ImageSetta

You may stop using ImageSetta at any time and remove it from your device.

Deleting ImageSetta does not itself:

• reverse an App Store transaction;
• constitute a refund request;
• cancel a Lifetime purchase;
• cause Apple to refund a transaction.

Refund, withdrawal, and cancellation rights are governed by applicable law and Apple's applicable purchase processes.

Sections that by their nature need to remain effective after use ends, including provisions concerning:

• intellectual property;
• disputes;
• liability;
• fraud;
• legal claims;
• prior transactions

may continue to apply.

27. Governing Law

These Terms are governed by Swedish law.

If you are a consumer, this choice of law does not deprive you of mandatory consumer protections that apply in your country of residence and cannot lawfully be excluded by contract.

Where mandatory law gives you a right to:

• bring proceedings in another competent jurisdiction;
• rely on mandatory local consumer law;
• obtain a remedy unavailable under Swedish contractual law,

these Terms do not remove that right.

28. Disputes

This gives ImageSetta a reasonable opportunity to:

• understand the issue;
• investigate relevant technical facts;
• verify a transaction where relevant;
• attempt to resolve the matter informally.

This does not prevent you from:

• contacting a consumer-protection authority;
• contacting a data-protection authority where relevant;
• using an available alternative dispute-resolution procedure;
• bringing a claim before a competent court;
• exercising another mandatory legal right.

Nothing in these Terms requires you to:

• surrender a mandatory legal right;
• waive access to a competent court;
• waive a mandatory consumer remedy.

29. Relationship With Apple's Standard EULA

ImageSetta is distributed through Apple's App Store.

Unless a Custom EULA is expressly provided for ImageSetta through Apple, the license to use the downloaded application is governed by Apple's Standard End User License Agreement.

These Terms are additional terms governing ImageSetta and related services.

They are intended to supplement, not replace, Apple's applicable Standard EULA.

If there is a conflict concerning a matter governed by Apple's mandatory App Store terms or Standard EULA, those applicable Apple terms control to the extent required.

If there is a conflict with mandatory law, mandatory law controls.

30. Language

ImageSetta and these Terms may be made available in multiple languages.

The English version is the master version used for interpretation where applicable law permits.

Translations are intended to communicate the same substantive meaning.

A translation may not be interpreted to:

• remove mandatory consumer rights;
• reduce mandatory statutory protections;
• create rights that the corresponding English provision does not contain merely because of an unintended translation discrepancy.

Where applicable law requires:

• a local-language version to prevail;
• a local-language interpretation to control;
• a particular interpretation favorable to the consumer,

that legal requirement prevails.

31. Severability

If a provision of these Terms is found invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

An invalid or unenforceable provision should be limited, interpreted, or adjusted only as much as necessary to make it lawful and enforceable where applicable law permits.

The invalidity of one provision does not automatically invalidate the remainder of these Terms.

32. Entire Terms

These Terms, together with:

• Apple's applicable App Store terms;
• Apple's applicable Standard EULA;
• ImageSetta's Privacy Policy;
• any mandatory legal rights that apply,

form the applicable framework governing your use of ImageSetta and related services.

ImageSetta's Privacy Policy separately explains how personal data is handled.

Nothing in this section makes a provision enforceable where mandatory law provides otherwise.
